These terms of confidentiality of personal data (hereinafter – the Confidentiality Terms) are applied to all information posted on website www.pushkininstitute.ru (hereinafter – the Website), which Pushkin State Russian Language Institute (hereinafter – the Operator) set up and operating under the laws of the Russian Federation, being the Website administrator and owner, may receive about the User while using the Website, its services and materials posted on it.
Registration on the Website as well as the use of the Website services and materials posted on it means the User’s unconditional consent to the present Confidentiality Terms and their conditions of confidentiality. In case of disagreement with these conditions the User shall refrain from using the Website services and features.
1. General Conditions
1.1. Within the present Confidentiality Terms the ‘confidential information’ means:
1.1.1. Personal information which the users provide about themselves on their own at registration (when creating User Account) or while using the Website services and materials, including User's family name, first name and e-mail address. The list of the personal data provided by the User may be expanded by introducing changes to these Confidentiality Terms.
1.1.2. The data automatically transmitted to the Website services, which are used by the User device software including IP-address, cookie files data, Users’ browser (or another software which helps to access services), technical characteristics of the Users’ equipment and software, date and time of the services access, requested pages addresses and other similar information.
1.1.3 Information received by the User in the process of training and available to the User on the Website.
1.2. These Confidentiality Terms are applied exclusively to the Website www.pushkininstitute.ru. The Website neither controls nor holds responsibility for the third parties’ websites to which the users may go following the links available on the Website www.pushkininstitute.ru.
1.3. Having received the access to the Users’ confidential information, the Operator commits himself to ensure its confidentiality, not to disclose it to third parties or to disseminate the personal data without the users’ consent unless otherwise envisaged by the Federal Law of 27.07.2006 № 152-FZ ‘On Personal Data’ and these Confidentiality Terms.
2. The Objectives of the Confidential Information Collection and Processing
2.1. The Operator collects and stores only the information which is needed for the provision of the Website operational services and features, except for cases when it is required by law to store confidential information for a certain period of time.
2.2. The Website processes the User’s personal data for the following purposes:
2.2.1. identification of the User registered on the Website, for the provision of services available on the Website;
2.2.2. providing access to the User to the Website personalized resources;
2.2.3. setting up feedback with the User, which includes sending notifications and requests related to the Website use and the provision of services as well as the processing of requests and applications from the User;
2.2.4. determination of the User’s location for the statistical analysis of the demand for the Website services;
2.2.5. creation of the user account to receive access to the Website services if the User gives his consent to create User Account;
2.2.6. provision of support to the User in case of problems related to the Website use.
3. Conditions for the Processing and Storing of the Users’ Confidential Information
3.1. The processing of confidential information is carried out without limitations by any legal means, including the use of automatic or electronic reception means.
The processing of the Users’ personal data is carried out in accordance with the Federal Law of 27.07.2006 № 152-FZ ‘On Personal Data’ and the Regulation on the Protection of Personal Data (policy in relation to personal data).
The processing of personal data means any action (operation) or a set of actions (operations) performed with or without the use of automatic means in relation to personal data, including collection, recording, systematization, accumulation, storage, specification (update, change), retrieval, use, transmission (dissemination, provision, access), depersonalization, blocking, removal, destruction of personal data.
3.2. In case of a loss or a disclosure of personal data the Operator informs the User on the loss or disclosure of personal data.
3.3. In case of a loss or a disclosure of confidential information the Operator bears no responsibility if this confidential information:
3.3.1. had been made available to the public before its loss or disclosure;
3.3.2. had been received from a third party before it was received by the Operator;
3.3.3. was disclosed with the consent of the User.
3.3. the Operator undertakes necessary legal, organizational and technical measures in order to protect confidential information from an illegal or an accidental access to it, destruction, change, blocking, copying, provision and dissemination of confidential information as well as from other illegal actions in relation to confidential information.
3.4. The Operator together with the User undertake all the necessary measures in order to prevent damage or other negative consequences caused by the loss or disclosure of confidential information.
3.5. The Operator shall:
3.5.1. use the received personal data exclusively for the purposes outlined in these Confidentiality Terms;
3.5.2. store the confidential information in secrecy, not disclose it without prior written consent of the User, and not sell, change, publish or disclose by any other ways the confidential information, which was transmitted to it, except for the cases prescribed by these Confidentiality Terms;
3.5.3. take precautionary measures to protect confidentiality of the User’s personal data in line with the order, which is normally used to protect such information in the existing business practices;
3.5.4. block access to personal data regarding a relevant User upon the receipt of an application or a request of the User, his authorized representative or an authorized body responsible for the protection of rights of the personal data owners for the period of inspection if invalid personal data or illegal actions have been detected.
3.6 The Operator stores confidential information in the form which allows the User to be determined as an owner of personal data no longer than it is required by the aims of the confidential information processing. The processed personal information is to be destroyed or depersonalized when the aims of the processing are achieved or when there is no further need to achieve these aims.
4. Conditions and Order of the Transferring the Confidential Information to Third Parties
4.1. The confidentiality of the User’s confidential information is maintained except for the cases when the User voluntarily provides information about himself for a common access of an unlimited range of people. When using some Website services the User agrees that a certain part of his confidential information becomes accessible to the public.
4.2. The Operator has the right to provide the User’s personal information to third parties in the following cases:
4.2.1. when the User agrees to such actions;
4.2.2. when such provision is necessary for the User’s use of a certain Website feature or service;
4.2.3. when the transfer is envisaged by the Russian or other applied legislation within an established legislative procedure.
5. User’s Rights and Obligations
5.1 The User has the right to:
5.1.1 receive information related to the processing of his personal information, including personal data; The User’s right to access his personal data may be limited in line with the federal laws;
5.1.2 require from the Operator to specify his confidential information, including personal data, their blocking access to or destruction if the personal data are incomplete, outdated, imperfect, received illegally or are not required for the declared aim of processing as well as to undertake legal measures to protect his rights;
5.2 User’s Obligations are:
5.2.1. to provide information of personal data needed for the use of the Website;
5.2.2 to update and amend provided information on personal data if this information is changed.
6. Additional Terms
6.1. The Operator has the right to introduce changes to these Terms of Confidentiality without the User’s consent.
6.2. Updated Confidentiality Terms enter into force since posted on the Website unless otherwise prescribed by the new version of the Confidentiality Terms.
6.3. These Confidentiality Terms and relations between the User and the Website Administration are regulated by the effective legislation of the Russian Federation.
